ebay query - lost in post!
Hi all

I'm hoping you can help - I sold a necklace on ebay and posted it 2nd class on monday.

The buyer says it still hasn't turned up and she is due to move out of her flat tomorrow so says if it hasn't turned up by then she wants a refund :cmdunno:

However a) I stated on the ebay t and c that i don't accept responsibility for things getting lost in the post and that I always get proof of posting

b) I have proof of posting

c) surely its not my fault that she is moving out and it should be her responsibility to get her post forwarded

d) there have been postal strikes so its poss it might still turn up.

What do you think? Do I have to refund?

Sorry that was a bit long! xx
Answer:
You only posted it MOnday 2nd class what unearth does she expect?!
I would say that as you paid for 2nd class postage it can take up to 10 days (or whatever it is) to arrive and that you cannot give a refund simply because she is moving, if she has her post forwarded then she will receive when it was originally due.
I think thsi buyer is being very cheeky.
However if you'd rather not risk a fuss then you can use the proof of posting to claim your cost back, although you'd probably have to wait longer than a week.
Answer:
Hmmm tricky one.
You are indeed right, there's been a postal strike so it could still turn up and it's not your fault she's moving, I think depending on how much the item is you could go 50/50 if it doesn't turn up? If you have proof of posting can you not claim the money back from Royal Mail? I've never used one of these forms so don't know how they work.
If the buyer is genuine you have to put yourself in your shoes, she's paid for a necklace which she hasn't got.
To be honest this is why I send EVERYTHING on Ebay recorded delivery, there's a lot of untrustworthy people using Ebay, along with postal strikes and post nicking, it's just not worth taking the risk sending anything standard post.
Good luck!
Answer:
it could easily still turn up but if i were moving i wouldn't have things posted to my old address. if she paid with paypal you have no choice but to refund her, they'll take the money out of your account if she opens a dispute no matter what you said in your tcs. it's the seller's responsibility to get proof of delivery, not proof of posting. if it was worth less than £28 or whatever the amount is these days then you can get compensation from the post office with your proof of posting after a certain number of days though.
Answer:
Does it make any difference if you state that you won't take responsibility for things getting lost in the post? I don't think that would wash with paypal tbh
