How many here have filed? I know it's extreamly personal, but we are in a situation right now and we are contemplating the Big B. I don't know what to do!!! It's not credit card debt, we really don't have any, it all medical... tons of medical and they are killing us!!! it's just a long story and a huge mess. anyway just wondering if anybody has any info and/or stories to share . We never filed bankruptcy, but I can understand the stress of medical bills! My DH had thousands of dollars of medical bills that we were paying on for 10 yrs. Well, I called one day to talk to someone about a new payment plan and she put me in touch with head of billing, they were willing to cut our bill in 1/2 since we had been paying so long. I don't know if this helps, but good luck, I know how overwhelming it can be

If you're considering bankruptcy then I suggest that you sit down with a financial advisor who can look at your debts and assests to make a reccomendation. While the decision is still yours it would help to get the opinion of someone who has experience in the area. Good luck and keep your chin up

We filed several years ago. It really helped. I always said that I did not believe in bankruptcy. If you make the debt you should repay it. But like you, we had so many bills that were beyond our control. When my son died we were left with almost $10,000 in hospital bills after insurnace and we had loss of income from the work we missed and dh quit his second job because he just could not do it anymore. We had life insurance on him, and received alot of help, but things just kinda snowballed from there and we could never catch up. We filed about 5 years ago. It really helped us. We have since refinanced the house we had and now bought a different one. Our credit has been really good since then. I know the laws have changed since then, call a bankruptcy lawyer and have a free consultation. Best of luck to you!

We filed in oct of 2006 , I suggest you get with a lawyer and let him look things over . We did it because we were so far in debt we were about to lose everything, We had to hide our van until we got our case number , close any bank account where I had cc ,because they can freeze your accouints and all money coming into including savings. We lived on pins and needles for about a week because until we had that case numbr any creditors could come take any property. Its a huge step and the laws have changed alot so the best thing you can do is seek a lawyer. good luck to you

See thats just it things have snowballed so much that we are at the breaking point. My husband hurt his back and was out of work for awhile then I had surgery with some major complications back in Oct. We are behind in our house pmt, car pmt, tons of medical bills that the insurance didn't cover, ahhhhh it's just a mess!!! I feel like we shouldn't do bankruptcy, because it is our debt. Ya know? But we can't get out from under it. We have a consultation set up with an attorney to discuss the situation, he brought up chapter 13, a repayment plan. From what I gather we would be protected by the courts, and pay a monthly pmt we can afford to the trustee and they distribute the money. That sounds better than just not paying at all.... to me anyway. Thanks for your help.

Good luck to you. We finalized our bankruptcy in August 06. Like the previous posters I suggest going to an attorney. Most of them will sit down and do a free consultation and go over your debt. They will figure out what debt compared to income is, the size of your family. They figure in everything! Even food and clothing. Also each state has a median income and if you are a certain percentage under that then they consider you "eligible" for bankruptcy.
We are in Wisconsin and the only thing additional with the new rules is that you have to take a pre and post bankruptcy education class. You can do this online and it does cost an additional approximately $50 for both to take it. I also believe since the new laws the attorneys have upped their fees. We started the process in February 06 and it was not legally filed until August 06. Again good luck and feel free to ask more questions if needed.

You do know that with medical bills you can send as little as 10 dollars. Pay all your bills and buy food first then pay on medical. I often wish we had socialized medicine.
